The iPad Prize includes one (1) 16GB Apple iPad with an estimated retail value (“ERV”) of $499.00 (USD).

1. ELIGIBILITY: The Local Planet iPad Giveaway ("Sweepstakes") is open only to legal residents of the 50 United States and the District of Columbia, who are age 18 years or older and are registered members of the localplanet.com website (the "Site"). Registered members must have a valid username and password The following persons are not eligible: employees and their spouses (and their immediate families (parent, child, sibling and any of their respective spouses, regardless of where they reside)) and household members of (whether or not related) of Local Planet, LLC ("Sponsor"), and its respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, including Sponsor, the "Sweepstakes Entities").  Apple, Inc. is not a sponsor of the Sweepstakes and has not endorsed and has nothing to do with the Sweepstakes.

The Sweepstakes is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Sweepstakes, users agree to accept and be bound by all terms of these Official Rules and Regulations ("Official Rules") and the decisions of Sponsor, which are final and binding. Void where prohibited or restricted by law.

2. HOW TO ENTER:

To enter the Sweepstakes, participants must register with the Site creating a valid username and password and click on the register button to submit an entry.  By registering, you will also be subscribing to receive Local Planet e-mails.  To opt-out of Local Planet e-mails, please [e-mail unsubscribe@localplanet.com and type “UNSUBSCRIBE” in the subject line] or follow the instructions at the bottom of the Local Planet e-mails.   

To be eligible for the applicable Sweepstakes, all entries must be submitted between 12:01 a.m. on June 22, 2010and 11:59 p.m. on July 20, 2010.  Sponsor's computers will be the official timekeeper. LIMIT: One entry per e-mail address and/or per person. Entries must be submitted in the name of an eligible living person and the prize(s) can only be awarded to the person or e-mail account holder whose name is on or corresponds to the winning entry. In the event multiple entries are received by one person and/or one e-mail address, only the first entry will be accepted. In the eventuality of a dispute, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.  Potential winner may be required to show proof of being the authorized account holder. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.  Entrants subject to all notices posted at www.localplanet.com, including but not limited to terms of use and privacy policy. Multiple entries received in violation of the above entry limitation, false or deceptive acts or entries, or entries generated by scrip, macro or other automated means will be void, will render a participant ineligible, and also may result in participant no longer being allowed to enter Sponsor's sweepstakes, contests or other promotions in the future, at Sponsor's sole discretion.  All entries become the property of Sponsor and will not be acknowledged.

The Sweepstakes Entities and their respective employees, officers, directors, representatives and agents (collectively, the "Released Parties") are not responsible for technical, hardware or software failures of any kind, lost or unavailable network, cable, satellite, Internet Service Provider, telephone, telephone lines or other connections, preemptions, blackouts or any other non-controllable acts concerning a television broadcast, or incorrect, incomplete, misdirected, undelivered, lost, late, garbled or stolen entries or computer transmissions, or other errors or problems of any kind which may limit or affect a person's ability to participate in the Sweepstakes. In the event of sabotage, acts of God, terrorism, computer virus, worm, bug, or other events or causes beyond Sponsor's reasonable control, which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsor reserves the right to cancel, modify or suspend the Sweepstakes. In the event of cancellation, the prize for the Sweepstakes will be awarded from among all eligible, non-suspect entries received up to the time of such action.

3. WINNER SELECTION; ODDS: One (1) potential winner for the Sweepstakes will be randomly selected by Sponsor from among all eligible entries received during the entry period for the Sweepstakes. The odds of winning will depend on the total number of eligible entries received.

The Sweepstakes will be administered by Sponsor. The decisions of Sponsor in all matters regarding the Sweepstakes are final and binding. The potential winner will be notified within two (2) weeks following the Sweepstakes drawing via telephone, mail or email. The potential winner must meet all eligibility requirements, including the timely execution and return of all required Winner Documents (as defined in section 5 below) or the Sweepstakes prize will be forfeited and an alternate potential winner will be selected for the Sweepstakes, at Sponsor's sole discretion.  The winner should receive his/her prize within four (4) to six (6) weeks of selection.

4. PRIZE(S): One (1) winner (when verified by the Sponsor as set forth above, the "Winner") of the Sweepstakes will receive the Sweepstakes prize, as randomly determined by Sponsor. No substitution or transfer of prizes or cash redemption is permitted. Sponsor reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Winners are responsible for the reporting and payment of all federal, state and local taxes (if any) and any other costs and expenses associated with prize acceptance and use not specified in these Official Rules and/or in the applicable entry instructions as being provided. If any prize(s) has a total ERV of $600 or more, the Winner will receive an IRS 1099 form reflecting the value of the prize(s). Other terms, conditions and eligibility requirements may apply depending upon the nature of the applicable Sweepstakes prize. All prize details and additional terms, conditions or eligibility requirements are at Sponsor's discretion.

5. GENERAL: By participating in the Sweepstakes and accepting a prize, the Winner grants the Sweepstakes Entities the right, unless prohibited by law, to use the winner's name, voice and likeness, without compensation, or additional notification or approval, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes, in any manner or medium, throughout the world in perpetuity. The Winner may be required to sign affidavits of eligibility, prize acceptance forms, tax acknowledgment forms, liability releases and, except where prohibited by law, use of name and likeness releases (collective, "Winner Documents") and to return these within five (5) days of receipt. If (i) a prize or prize notification is returned as undeliverable, (ii) a Winner fails to properly and/or timely reply to and/or return all Winner Documents within the time specified above, (iii) a Winner declines his or her prize, or (iv) a Winner fails to comply with any of the Official Rules and Regulations as outlined herein, such Winner will be disqualified and an alternate potential winner will be selected by random drawing at Sponsor's discretion.

THE RELEASED PARTIES EXPRESSLY DISCLAIM ANY RESPONSIBILITY AND PARTICIPANTS AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS AND AGENTS, FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS AND/OR LIABILITY FOR INJURY, DAMAGE OR LOSS TO ANY PERSON OR PROPERTY RELATING TO OR ARISING IN CONNECTION WITH PARTICIPATION IN ANY SWEEPSTAKES (REGARDLESS OF THE CAUSE OF SUCH INJURY OR LOSS), THE DELIVERY AND/OR SUBSEQUENT USE OR MISUSE OF ANY OF THE PRIZES AWARDED AND/OR PRINTING, DISTRIBUTION OR PRODUCTION ERRORS. PARTICIPANTS AND THEIR PARENTS/LEGAL GUARDIANS ACKNOWLEDGE THAT PRIZES ARE AWARDED "AS IS" AND THAT SPONSOR HAS NOT MADE, AND IS NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY REPRESENTATION, GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN LAW OR IN FACT, RELATIVE TO ANY PRIZE, INCLUDING, BUT NOT LIMITED TO ITS QUALITY, MECHANICAL CONDITION OR FITNESS FOR A PARTICULAR PURPOSE.

6. DISPUTES: Except where prohibited, participants agree that (1) any and all disputes, claims and causes of action arising out of or connected with a Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action and exclusively by the appropriate court located in Fulton County, Georgia; (2) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with participating in a Sweepstakes, but in no event attorneys fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than for actual out of pocket expense and any and all rights to have damages multiplies or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or participants' and/or Sponsor's rights and obligations in connection with a Sweepstakes shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
